(First Published in the Lawrence Daily Journal- World on the 12th of September, 2025) RESOLUTION NO. 2025-23 A RESOLUTION OF THE CITY OF EUDORA, KANSAS PROVIDING FOR A PUBLIC HEARING TO CONSIDER THE CANCELLATION OF A PLAT PURSUANT TO K.S.A. 12-505 ET SEQ. AND AMENDMENTS THERETO WHEREAS, a request has been submitted to the City of Eudora, Kansas seeking cancellation of the recorded plat of the Fairfield Addition (hereto referred to as "the Property); and WHEREAS, K.S.A. 12-505 et seq. and amendments thereto provide a statutory procedure for the vacation and cancellation of plats or portions thereof; and WHEREAS, the City of Eudora passed Resolution 2025-21 calling for a public hearing, which is hereby repealed and replaced by this resolution upon its passing; and WHEREAS, prior to action upon such request, the governing body of the City of Eudora is required by law to hold a public hearing, with due notice, to determine whether said plat or portion thereof should be cancelled. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS: Section 1. It is the intention of the Governing Body of the City of Eudora, Kansas, to consider the cancellation of the recorded plat for the Property, as described in Exhibit A hereto; Section 2. Notice is hereby given that a public hearing will be held by the Governing Body to consider the proposed cancellation of the recorded plat for the Property on October 27, 2025, at Eudora City Hall, 4 E Seventh Street, Eudora, Kansas, 66025; the public hearing to commence at 7:00 pm or as soon thereafter as the Governing Body can hear the matter. At the public hearing, the Governing Body will receive public comment on the foregoing matters and may, after the conclusion of such a public hearing, consider the findings necessary for the cancellation of the recorded plat. Section 4. A copy of this resolution shall be published once in the official City newspaper not less than twenty (20) days preceding the date fixed for the public hearing. City staff is further hereby authorized and directed to notify all utility companies and other holders of interests in such property of the proposed cancellation of the recorded plat. Section 5. This resolution shall be effective upon its adoption by the City Commission of the City of Eudora, Kansas. ADOPTED this 8th day of September 2025 by the City Commission of the City of Eudora, Kansas.
