(First Published in the Lawrence Daily Journal- World on the 12th of September, 2025) RESOLUTION NO. 2025-22 A RESOLUTION DECLARING IT TO BE THE INTENT OF THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS, TO CONSIDER A PETITION FOR DEANNEXATION OF PROPERTY LOCATED IN THE CITY OF EUDORA, KANSAS WHEREAS, the Governing Body of the City of Eudora, Kansas, adopted Ordinance No. 857 on September 11, 2006, accepting the voluntary annexation of land to the City to be known as Fairfield Addition, described in its most current legal description as: A TRACT OF LAND SITUATED IN THE NORTHWEST QUARTER OF SECTION 16, TOWNSHIP 13 SOUTH, RANGE 21 EAST OF THE SIXTH PRINCIPAL MERIDIAN IN DOUGLAS COUNTY, KANSAS, NOW DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE WEST LINE OF SAIF QUARTER SECTION, SAID POINT BEING 950.17 FEET NORTH OF THE SOUTHWEST CORNER OF SAID SECTION; THENCE SOUTH 85 DEGREES, 00 MINUTES, 27 SECONDS EAST ALONG THE NORTH LINE OF MEADOWLARK ADDITION NO. 1, A SUBDIVISION IN THE CITY OF EUDORA, DOUGLAS COUNTY, KANSAS, 764.56 FEET TO THE NORTHWEST CORNER OF LOT 10, BLOCK 2 OF SAID MEADOWLARK ADDITION NO. 1; THENCE NORTH 02 DEGREES, 44 MINUTES, 11 SECONDS EAST ALONG THE WEST LINE OF MEADOWLARK ADDITION NO. 2, A SUBDIVISION IN SAID CITY OF EUDORA, 444.20 FEET TO THE NORTHWEST CORNER OF LOT 10, BLOCK B OF SAID MEADOWLARK ADDITION NO. 2; THENCE SOUTH 89 DEGREES, 44 MINUTES, 40 SECONDS WEST 386.42 FEET; THENCE NORTH 00 DEGREES, 15 MINUTES, 20 SECONDS WEST, 21.13 FEET; THENCE SOUTH 89 DEGREES, 44 MINUTES, 40 SECONDS WEST, 399.86 FEET TO A POINT ON THE WEST LINE OF SAID QUARTER SECTION; THENCE SOUTH 00 DEGREESM 30 MINUTES, 31 SECONDS EAST ALONG SAID WEST LINE, 394.79 FEET TO THE POINT OF BEGINNING. THE ABOVE CONTAINS 7.461 ACRES, MORE OR LESS, ALL IN DOUGLAS COUNTY, KANSAS, AND IS SUBJECT TO ALL RIGHTS-OF-WAY-EASEMENTS, RESTRICTIONS, AND COVENANTS OF RECORD, IF ANY and; WHEREAS, the Governing Body of the City of Eudora, Kansas has received a formal petition for de-annexation of the above-described property (hereto referred to as "the Property"). from the City of Eudora, Kansas; and WHEREAS, the City of Eudora passed Resolution 2025-20 calling for a public hearing, which is hereby repealed and replaced by this resolution upon its passing; and WHEREAS, the Governing Body of the City is formally considering the petition for de-annexation, as authorized under K.S.A. 12-504 NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS: Section 1. It is the intention of the Governing Body of the City of Eudora, Kansas, to consider the de-annexation petition of the Property, as described in Exhibit A hereto; Section 2. Notice is hereby given that a public hearing will be held by the Governing Body to consider the proposed de-annexation of the Property on October 27, 2025, at Eudora City Hall, 4 E Seventh Street, Eudora, Kansas, 66025; the public hearing to commence at 7:00 pm or as soon thereafter as the Governing Body can hear the matter. At the public hearing, the Governing Body will receive public comment on the foregoing matters and may, after the conclusion of such a public hearing, consider the findings necessary for the de-annexation of the Property. Section 4. A copy of this resolution shall be published once in the official City newspaper not less than twenty (20) days preceding the date fixed for the public hearing. City staff is further hereby authorized and directed to notify all utility companies and other holders of interests in such property of the proposed deannexation. Section 5. This resolution shall be effective upon its adoption by the City Commission of the City of Eudora, Kansas. ADOPTED this 8th day of September 2025 by the City Commission of the City of Eudora, Kansas.
