(First published in the Lawrence Daily Journal- World on July 19, 2018) RESOLUTION NO. 302 A RESOLUTION OF THE CITY OF LECOMPTON, KANSAS FINDING THAT THE STRUCTURES LOCATED AT 334 CLARK STREET, LOT A, LECOMPTON, KANSAS AND 334 CLARK STREET, LOT D, LECOMPTON, KANSAS, ARE DANGEROUS, UNSAFE, AND UNFIT FOR HUMAN USE OR HABITATION AND ORDERING THAT THE STRUCTURES BE REPAIRED OR REMOVED BY AUGUST 31, 2018. WHEREAS, Gail Tompkins is the record owner of certain residential property located at 334 Clark Street, Lot A, Lecompton, Douglas County, Kansas and 334 Clark Street, Lot D, Lecompton, Douglas County, Kansas (“the Property”); WHEREAS, Pat Ragan is the caretaker for the Property, an agent of the owner of the Property, and is believed to be in the process of acquiring the Property; WHEREAS, the City of Lecompton (“the City”) by Resolution No. 301 fixed a hearing for July 2, 2018 at 7:00 p.m. at City Hall for Tompkins and Ragan to appear and show cause as to why the structures on the Property should not be condemned and ordered repaired or demolished; WHEREAS, the City caused Resolution No. 301 to be published on May 25, 2018 and June 1, 2018 in the Lawrence Journal World and then on May 25, 2018 mailed copies of Resolution No. 301 to Tompkins and Ragan by certified mail; WHEREAS, on July 2, 2018, the City Council held a show cause hearing in this matter, and Tompkins and Ragan failed to appear in person at the hearing. NOW, based on the testimony of the witnesses and the evidence presented, the City Council hereby adopts the following resolution. BE IT RESOLVED BY THE CITY COUNCIL, CITY OF LECOMPTON, DOUGLAS COUNTY, KANSAS: That the structure located on 334 Clark Street, Lot A, is dangerous, unsafe, and unfit for human use or habitation due to electrical hazards and general/ structural hazardous conditions as described in the Douglas County Zoning & Codes Department’s Report of Inspection, dated May 21, 2018 and as depicted in the photographs attached thereto. BE IT FURTHER RESOLVED: That the structure located on 334 Clark Street, Lot D, is dangerous, unsafe, and unfit for human use or habitation due to electrical hazards, plumbing hazards, mechanical hazards, and general/structural hazardous conditions as described in the Douglas County Zoning & Codes Department’s Report of Inspection, dated May 21, 2018 and as depicted in the photographs attached thereto. BE IT FURTHER RESOLVED: That, based on the foregoing, the structures located on the Property are in violation of Chapter IV, Article 6 of the Lecompton City Code (Dangerous and Unfit Structures) and are hereby condemned. BE IT FURTHER RESOLVED: That Gail Tompkins and Pat Ragan shall have until August 31, 2018 to commence the repair or removal of the structures. If Gail Tompkins and Pat Ragan fail to commence the repair or removal of the structures by August 31, 2018 or fail to diligently prosecute the same until the work is completed, the City will cause the structures to be razed and removed. If the City causes the structures to be razed or removed, the costs incurred by the City, including reasonable attorney and inspection fees, shall be charged against the Property as provided in Sections 4-609 and 4-611 of the City Code unless otherwise timely paid. If the costs are not timely paid, the City may sell any salvage from the structure and apply the proceeds or any portion thereof to pay the costs incurred by the City. If the proceeds of the sale of salvage are insufficient or there is not salvage, the balance shall be assessed as special assessments against the Property, and the City Clerk shall, at the time of certifying other taxes to the County Clerk, certify the City’s costs. The County Clerk shall extend the same on the tax roll and it shall be collected by the County Treasurer and paid to the City of Lecompton, Kansas as other City taxes are collected and paid.
