(Published in the Lawrence Daily Journal- World on April 26, 2024) ORDINANCE NO. 1159 AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS MAKING FINDINGS AND ADOPTING A REDEVELOPMENT PROJECT PLAN PURSUANT TO K.S.A. 12-1770 ET SEQ., AND AMENDMENTS THERETO. WHEREAS, pursuant to the provisions of K.S.A. 12-1770 et seq., as amended (the "Act"), the City of Eudora, Kansas (the "City") is authorized to establish redevelopment districts within an "eligible area," as said term is defined in the Act; and WHEREAS, the City Commission (the "Governing Body") adopted Resolution No. 2016-15 on December 12, 2016, calling for a public hearing considering the establishment of a redevelopment district to be held by the Governing Body on January 23, 2017; and WHEREAS, notice of the public hearing on establishment of a redevelopment district was given as required by the Act; and WHEREAS, a public hearing on establishment of a redevelopment district was held on January 23, 2017; and WHEREAS, the City, by the passage of Ordinance No. 1061 on January 23, 2017 (i) made findings as to the real property described in Exhibits A and B hereto being a "conservation area," as defined in the Act, and (ii) created a redevelopment district (the "Redevelopment District") consisting of one redevelopment project area; and WHEREAS, the City is considering the adoption of a redevelopment project plan entitled Redevelopment Project Plan Nottingham Redevelopment District - Project Area 1 (the "Project Plan") which provides for the redevelopment of "Project Area 1" within the Redevelopment District; and WHEREAS, on March 6, 2024, the Planning Commission of the City made a finding that the Project Plan is consistent with the intent of the City's comprehensive plan for the development of the City; and WHEREAS, a copy of the Project Plan was delivered by the City to the Board of County Commissioners of Douglas County and to the Board of Education of Unified School District No. 491; and WHEREAS, the Governing Body adopted Resolution No. 2024-03 on March 11, 2024, calling for a public hearing considering the adoption of the Project Plan to be held by the Governing Body on April 22, 2024; and WHEREAS, notice of a public hearing on adoption of the Project Plan was given as required by the Act; and WHEREAS, the public hearing on adoption of the Project Plan was held and closed on April 22, 2024. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS: SECTION I. The Governing Body hereby finds that all required notices and publications relating to the Redevelopment District and Project Plan were made in conformance with the Act. SECTION II. The "District Plan" for the Redevelopment District (as defined in and adopted pursuant to Ordinance No. 1061) is hereby amended to provide for two (2) redevelopment project areas, with Project Area 1 as described in Exhibits C and D hereto and a second redevelopment project area consisting of the balance of the Redevelopment District. Except as modified pursuant to the foregoing, the District Plan adopted pursuant to Ordinance No. 1061 is hereby ratified. SECTION III. The Governing Body hereby adopts the Project Plan, which governs redevelopment of the real property in Project Area 1, which is shown on Exhibit C and legally described on Exhibit D . SECTION IV. The Governing Body finds and determines that the Project Plan does not require a relocation assistance plan under the Act. SECTION V. The Mayor, City Manager, City Clerk and other officials and employees of the City are hereby authorized and directed to take such other actions as may be appropriate or desirable to accomplish the purposes of this Ordinance. SECTION VI. This Ordinance shall take effect and be in force from and after its passage by a 2/3 vote of the Governing Body and its publication once in the official City newspaper.
