(First Published in the Lawrence Daily Journal- World on the 17th of May, 2025) ORDINANCE NO. 10137 AN ORDINANCE AUTHORIZING THE CREATION OF A COMMUNITY IMPROVEMENT DISTRICT IN THE CITY OF LAWRENCE, KANSAS; AUTHORIZING THE MAKING OF CERTAIN PROJECT IMPROVEMENTS RELATING THERETO; APPROVING THE ESTIMATED COSTS OF SUCH PROJECT IMPROVEMENTS; LEVYING A COMMUNITY IMPROVEMENT DISTRICT SALES TAX WITHIN SUCH DISTRICT; PROVIDING FOR THE METHOD OF FINANCING THE SAME; AND AUTHORIZING EXECUTION OF A RELATED DEVELOPMENT AGREEMENT. WHEREAS, K.S.A. 12-6a26 et seq. (the "Act") authorizes the governing body of any city or county to create community improvement districts to finance projects within such defined area of the city or county and to levy a community improvement district sales tax upon property within the district to finance projects; and WHEREAS, a petition (the "Petition") was filed with the City Clerk proposing the creation of a community improvement district (the "District") under the Act and the imposition of a community improvement district sales tax (the "CID Sales Tax") in order to pay the costs of projects as described in the Petition (the "Projects"); and WHEREAS, the Petition was signed by the required number of owners of record, whether resident or not, as required by the Act; and WHEREAS, the City Commission (the "Governing Body") of the City of Lawrence, Kansas (the "City") intends to create the District and to levy the CID Sales Tax as requested in the Petition; and WHEREAS, the Act provides that prior to creating any community improvement district and imposing a community improvement district sales tax, the Governing Body shall, by resolution, direct and order a public hearing on the advisability of creating such community improvement district and the construction of such community improvement district projects therein, and to give notice of the hearing by publication at least once each week for two (2) consecutive weeks in the official City newspaper and by certified mail to all property owners within the proposed community improvement district, the second publication to be at least seven (7) days prior to the hearing and such certified mail sent at least ten (10) days prior to such hearing; and WHEREAS, the Governing Body adopted Resolution No. 7586 on April 8, 2025 (the "Resolution") directing that a public hearing on the proposed District within the City be held on May 6, 2025, declaring its intent to impose the CID Sales Tax, and requiring that the City Clerk provide for notice of such public hearing as set forth in the Act; and WHEREAS, the Resolution was sent via certified mail receipt to all property owners of record on April 21, 2025, and the Resolution was published once each week for two (2) consecutive weeks in Lawrence Journal World, the official City newspaper, on April 15, 2025 and April 22, 2025; and WHEREAS, on May 6, 2025, the Governing Body conducted a public hearing on the proposed District; and WHEREAS, the Governing Body hereby finds and determines it to be advisable to create the District and set forth the boundaries thereof, authorize the Projects as described herein, approve the estimated costs of the Projects and approve the method of financing the same, all in accordance with the provisions of the Act. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS: SECTION 1. Creation of Community Improvement District; Boundaries. The Governing Body hereby finds and determines that the Petition is sufficient, all publications and notices were duly given in accordance with the Act, and it is advisable to create the District within the City. A legal description of the boundaries of the District is set forth on Exhibit A , attached hereto and incorporated by reference herein. A map generally outlining the boundaries of the proposed District is attached as Exhibit B , attached hereto and incorporated by reference herein. SECTION 2. Authorization of Community Improvement District Projects and Estimated Costs. (a) The general nature of the Projects is approved as follows: (1) within the District, the acquisition, improvement, construction, demolition, removal, renovation, reconstruction, rehabilitation, maintenance, restoration, replacement, renewal, repair, installation, relocation, furnishing, equipping or extension of: (A) buildings, structures and facilities; (B) sidewalks, streets, roads, alleys, parking lots, utilities, pedestrian amenities, drainage systems, water systems, storm systems, sewer systems, lift stations, underground gas, heating and electrical services and connections located within or without the public right-of-way, water mains and extensions and other site improvements; (C) streetscape, lighting, street light fixtures, street light connections, street light facilities, benches or other seating furniture, trash receptacles, marquees, awnings, canopies, walls and barriers; (D) parks, lawns, trees and other landscape; (2) within or without the District, costs for infrastructure located outside the District but contiguous to any portion of the District and such infrastructure is related to a project within the District or substantially for the benefit of the District; and (3) the City's administrative costs in establishing and maintaining the District, and other items collectively permitted to be financed within the District under the Act and the City's Economic Development Policy. (b) The total estimated cost of the Projects is $5,600,000, a portion of which and the City's administrative costs are eligible to be funded by the CID Sales Tax ("Reimbursable Project Costs"), subject to any caps thereon set forth in the development agreement to be entered into between the City and the developer of the Projects (the "Development Agreement"). SECTION 3. Method of Financing. (a) The Projects will be privately financed. The Reimbursable Project Costs will be financed on a pay as you go basis, i.e., the Reimbursable Project Costs will be paid for by the developer of the Projects without the issuance of notes or bonds, and such developer will be reimbursed for the Reimbursable Project Costs as moneys are deposited in the CID fund through the imposition of the CID Sales Tax, as further set forth in the Development Agreement. The CID Sales Tax is hereby imposed at the rate of 2.0% on the sale of tangible personal property at retail or rendering or furnishing services which are taxable pursuant to the Kansas Retailers' Sales Tax Act (K.S.A. 79-3601 et seq.) within the District with such CID Sales Tax to commence on January 1, 2027 or such other date as the Governing Body sets by ordinance and continue for a period of up to twenty-two (22) years or such earlier date as provided in the Development Agreement. (b) There will be no issuance of bonds, including full faith and credit bonds, pursuant to the Act. (c) There will be no special assessments levied on property within the boundaries of the District to pay the cost of the Projects. SECTION 4. Segregation of CID Sales Tax Revenues. All revenues derived from the collection of the CID Sales Tax shall be deposited into a special fund of the City to be designated as The RKM KU Community Improvement District Revenue Fund. Such revenues shall be used to pay the costs of the Projects, including interest and the City's administrative fee set forth in the Development Agreement. SECTION 5. Development Agreement. The Development Agreement in substantially the form presented to the Governing Body of the City is hereby approved, and the City Manager and Clerk are hereby authorized to execute and deliver such Development Agreement on behalf of the City with such changes as may be approved by the City Attorney. SECTION 6. Effective Date. This Ordinance shall take effect and be in full force from and after its passage by the Governing Body and publication once in the official City newspaper. SECTION 7. Recording. The City Clerk shall file a certified copy of this Ordinance with the Register of Deeds of Douglas County, Kansas. (First Published in the Lawrence Daily Journal- World on the 17th of May, 2025) ORDINANCE NO. 10139 AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS MAKING FINDINGS AND ESTABLISHING A REDEVELOPMENT DISTRICT PURSUANT TO K.S.A. 12-1770 ET SEQ., AND AMENDMENTS THERETO. WHEREAS, pursuant to the provisions of K.S.A. 12-1770 et seq., as amended (the "Act"), the City of Lawrence, Kansas (the "City") is authorized to establish redevelopment districts within a defined area of the City that is an "eligible area" as defined in the Act; and WHEREAS, under a letter dated December 7, 2024, the City Commission (the "Governing Body") received an application for economic incentives (the "Application"), including incentives provided under the Act; and WHEREAS, the Governing Body adopted Resolution No. 7582 on April 1, 2025, calling for a public hearing considering the establishment of a redevelopment district to be held by the Governing Body on May 6, 2025; and WHEREAS, notice of the public hearing was given as required by the Act; and WHEREAS, the public hearing was opened on May 6, 2025, and closed on the same date. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS: SECTION 1. Based in part on the facts and data set forth in the Application, the Governing Body hereby finds that the real property described in Exhibits A and B (the "Redevelopment District") attached hereto is an "eligible area" as defined in the Act because it contains a building which is 65 years of age or older and any contiguous vacant or condemned lots and is therefore an eligible area for being designated as a redevelopment district under the Act. SECTION 2. The Governing Body hereby finds that the real property described in Exhibits A and B is the same real property designated in the notice of public hearing given as required by the Act and Resolution No. 7582. SECTION 3. The Governing Body hereby finds that the conservation, development or redevelopment of the Redevelopment District is necessary to promote the general and economic welfare of the City. SECTION 4. The Governing Body hereby establishes the Redevelopment District, which shall consist of one project area as depicted on the map attached hereto as Exhibit A. The district plan is hereby approved, and consists of buildings and facilities to be constructed within the Redevelopment District generally described as follows: A mixed-use development containing one (1) redevelopment project area consisting of some or all of the following uses and improvements, without limitation: a multi-sport athletic complex for collegiate and other sports uses and events, residential facilities, including multifamily; office space; restaurants; retailers; hotel uses; commercial uses; associated public and private infrastructure; site work, including demolition; utilities; storm water and drainage; landscaping; parking facilities; and other items allowable under the Act. SECTION 5. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. (First Published in the Lawrence Daily Journal- World on the 17th of May, 2025) ORDINANCE NO. 10140 AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ESTABLISHING A STAR BOND PROJECT DISTRICT PURSUANT TO K.S.A. 12-17,160 ET SEQ. AND MAKING CERTAIN FINDINGS IN CONJUNCTION THEREWITH (KU GATEWAY STAR BOND PROJECT DISTRICT). WHEREAS, pursuant to K.S.A. 12-17,160 et seq. (the "Act"), the City Commission (the "City Commission") of the City of Lawrence, Kansas (the "City") is authorized to create a STAR bond project district within an eligible area of the City for certain purposes set forth in the Act; and WHEREAS, the City Commission has adopted Resolution No. 7583 (the "Resolution") which provided that: (a) the City is considering establishment of a STAR bond project district to be known as the "KU Gateway STAR Bond Project District" (the "District") to promote, stimulate and develop the general and economic welfare of the state of Kansas and the City as a major commercial entertainment and tourism area that includes a major multi-sport athletic complex; (b) described the proposed boundaries of the District; (c) described the District plan; (d) stated that a description and map of the proposed District is available for inspection at City Hall at 6 East 6th Street, Lawrence, Kansas 66044, during regular business hours; (e) called a public hearing on the establishment of the District to be held on May 6, 2025 at 5:45 p.m. or as soon thereafter as possible, in the Commission Chambers located in City Hall at 6 East 6th Street, Lawrence, Kansas 66044; and (f) stated that the City Commission will consider findings necessary for establishment of the District; and WHEREAS, the proposed District consists of approximately 800 acres generally located at the University of Kansas - Lawrence campus, including public rights of way adjacent thereto, all within the City; and WHEREAS, notice of the public hearing was provided in accordance with the provisions of the Act, by: (a) providing a copy of the Resolution via certified mail, return receipt requested, to the Board of County Commissioners of Douglas County, Kansas and the Board of Education of USD 497, Douglas County, Kansas; (b) providing a copy of the Resolution via certified mail, return receipt requested, to each owner and occupant of land within the proposed District not more than 10 days following the date of adoption of the Resolution; (c) publishing a copy of the Resolution once in the official City newspaper not less than one week nor more than two weeks preceding the date fixed for the public hearing; and (d) posting a copy of the Resolution at a prominent location on the first page of the website of the City; and WHEREAS, pursuant to such notice the public hearing was conducted by the City Commission on May 6, 2025; and WHEREAS, the City has received from the Secretary of Commerce of the State of Kansas (the "Secretary") a determination that the proposed District is an "eligible area" as said term is defined in the Act; and WHEREAS, the City Commission desires to establish the District in accordance with the provisions of the Act. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LAWRENCE, KANSAS, AS FOLLOWS: Section 1. Findings. The City Commission hereby finds that notice of the public hearing conducted on this date was made in accordance with the provisions of the Act. The City Commission hereby further finds and determines that the proposed District described in the Resolution constitutes a "major commercial entertainment and tourism area" including a "major multi-sport athletic complex" and an "eligible area" and therefore a "STAR bond project," all as such terms are defined in the Act. Section 2. Creation of STAR Bond Project District. A STAR bond project district is hereby created within the City in accordance with the provisions of the Act, which shall consist of the real estate legally described on Exhibit A attached hereto, which is incorporated herein by reference, and shall be known as the "KU Gateway STAR Bond Project District." A map depicting the boundaries of the District is attached hereto as Exhibit B, which is incorporated herein by reference. The boundaries of the District do not contain any property not referenced in the Resolution, which provided notice of the public hearing on the creation of the District. Section 3. District Plan. Within the District, it is anticipated that a mixed-use development project (the "Project") will be developed by the University of Kansas and other private development entities that will feature distinct tourism, sports, and entertainment opportunities not already available in the City. The following preliminary plan for the proposed District (the "District Plan"), as presented to the City Commission this date is hereby approved: The buildings and facilities to be constructed or improved in the KU Gateway STAR Bond Project District generally include a mixed-use development consisting of some or all of the following uses: a multi-sport athletic complex for collegiate and other sports uses and events, entertainment uses, including retail uses, restaurant uses, and other general commercial development; hotel uses; residential uses, including multi-family residential facilities; visitor amenities; and associated streets and other public and private infrastructure. The KU Gateway STAR Bond Project District may consist of one or more STAR bond project areas as delineated in one or more STAR bond project plans to be approved for property within the STAR bond project district. Section 4. STAR Bond Project Areas. The District is contemplated to include one STAR Bond Project Area as more specifically set forth below: Comprised of approximately 800 acres of land contiguous to the boundaries of the KU Gateway STAR Bond Project District and generally located at the University of Kansas - Lawrence campus, all as legally described on Exhibit A and generally depicted on Exhibit B attached hereto, and to be constructed or improved to generally include a mixed-use development consisting of some or all of the following uses: a multi-sport athletic complex for collegiate and other sports uses and events, entertainment uses, including retail uses, restaurant uses, and other general commercial development; hotel uses; residential uses, including multi-family residential facilities; visitor amenities; and associated streets and other public and private infrastructure. Section 5. Applicable Incentives. The following state, federal, and local tax incentives apply, or are anticipated to apply, within the District, or a business located or to be located within the District: STAR bond financing; tax exempt financing; community improvement district financing; general improvement and assessment financing; tax increment financing; transportation development district financing; and/or economic development revenue bond financing and related tax abatements and exemptions. Section 6. Approval of Other Governmental Units. No privately owned property subject to ad valorem taxation within the District shall be acquired and redeveloped pursuant to the Act if the Board of County Commissioners of Douglas County, Kansas and the Board of Education of USD 497 (Lawrence) determines by resolution adopted within thirty days following the public hearing held this date, that the District will have an adverse effect on Douglas County or USD 497, respectively. Further Action. The Mayor, City Manager, City Clerk and other officials and employees of the City, including Gilmore & Bell, P.C., Bond Counsel, are hereby further authorized and directed to take such other actions as may be appropriate or desirable to accomplish the purposes of this Ordinance. Effective Date. This Ordinance shall be effective upon its passage by the City Commission, approval by the Mayor, and publication one time in the official City newspaper.
